| The decisions you make in the first hour can define your entire case. Work this list. |
IMMEDIATELY
- Move to safety if you can — get out of traffic lanes
- Call 911. Texas law requires it. Do it now.
- Do NOT move the bike unless it’s blocking a highway and creating immediate danger
- Check yourself for injuries — tell the paramedics every place that hurts, even if it seems minor
- NEVER say “I’m fine” or “I’m okay” — say “I need to be evaluated.”
AT THE SCENE
- Photograph everything: crash scene, all vehicle damage, your injuries, skid marks, road conditions, license plates, traffic signals
- Get the other driver’s name, phone, license number, plate, insurance company, and policy number
- Get names and phone numbers of every witness
- Note every nearby camera — businesses, traffic lights, doorbells. Write down the address.
- Get the officer’s name and badge number
WHAT NOT TO DO
- Do NOT admit fault — not to the driver, not to witnesses, not to police
- Do NOT give a recorded statement to anyone
- Do NOT sign anything at the scene
- Do NOT post about the crash on social media
BEFORE YOU SLEEP TONIGHT
- Go to the ER or urgent care — even if you feel okay. Adrenaline hides injuries.
- Call a trusted motorcycle injury attorney — most talk to you immediately, for free
- Notify YOUR insurance company that a crash occurred
- Do NOT contact the other driver’s insurance without speaking to a lawyer first
| Road Justice Tip: Never say “I’m okay.” Never sign anything. Never talk to their insurance without a lawyer. These three mistakes cost riders thousands of dollars every single day. |
