What to do After a Crash

Jared's Story

#1 What To Do in the First 60 Minutes After a Motorcycle Crash

The decisions you make in the first hour can define your entire case. Work this list.

IMMEDIATELY

  1. Move to safety if you can — get out of traffic lanes
  2. Call 911. Texas law requires it. Do it now.
  3. Do NOT move the bike unless it’s blocking a highway and creating immediate danger
  4. Check yourself for injuries — tell the paramedics every place that hurts, even if it seems minor
  5. NEVER say “I’m fine” or “I’m okay” — say “I need to be evaluated.”

AT THE SCENE

  1. Photograph everything: crash scene, all vehicle damage, your injuries, skid marks, road conditions, license plates, traffic signals
  2. Get the other driver’s name, phone, license number, plate, insurance company, and policy number
  3. Get names and phone numbers of every witness
  4. Note every nearby camera — businesses, traffic lights, doorbells. Write down the address.
  5. Get the officer’s name and badge number

WHAT NOT TO DO

  • Do NOT admit fault — not to the driver, not to witnesses, not to police
  • Do NOT give a recorded statement to anyone
  • Do NOT sign anything at the scene
  • Do NOT post about the crash on social media

BEFORE YOU SLEEP TONIGHT

  1. Go to the ER or urgent care — even if you feel okay. Adrenaline hides injuries.
  2. Call a trusted motorcycle injury attorney — most talk to you immediately, for free
  3. Notify YOUR insurance company that a crash occurred
  4. Do NOT contact the other driver’s insurance without speaking to a lawyer first
Road Justice Tip: Never say “I’m okay.” Never sign anything. Never talk to their insurance without a lawyer. These three mistakes cost riders thousands of dollars every single day.
